General

As used in this Privacy Policy, “Personal Information” means information that may be used to identify a specific individual or that is about an identifiable individual, including but not limited to name, email address, or phone number. “Aggregate Information” refers to combined demographic information which has been derived from Personal Information, but which cannot be reasonably used to identify any individual.  “Website” refers to xsense.co.  “We”, “us”, and BT9 refer to BT9 Ltd. and subsidiaries.

Information We Collect On the Website and How We Use It

We collect and use personal information in the specific ways listed below:

User Accounts

Users accounts are used for controlling access to the password-protect portion of the Website.  If one receives a user account from us upon first log-in, one will be asked to register one’s name, company name, title, email address and phone number, hereafter referred to as “Contact Information”. This Contact Information is used for communicating with the person and as source information for actions requested on the Website, such as requests of Xsense® Support. We may also use one’s email address to send one promotional messages, product updates, and other communications unless one opts out of such emails.

Information Requests and Feedback

The Website contains various user interfaces to allow visitors to the Website to request more information about our products and services, or to provide feedback about them. Personal Information is requested in either case, along with information about one’s computing environment and/or industry, and details of one’s request or feedback. This information is used in order to allow us to understand and respond to one’s submission and to better understand our customers’ needs.

Surveys

From time to time, surveys may appear on the Website, in which case, we will collect Personal Information from the participants in the survey. This information will be used to administer the survey, to analyze its results, and for other specific purposes which are disclosed at the time of collection. Survey responses are processed as Aggregate Information before survey results are shared with any third parties

How We Share Your Information

We do not share your personal information collected on the Website with third parties without your permission, except as necessary or appropriate to (i) carry out the transaction, activity or request made by you on the Website, (ii) comply with any applicable law, court order or other judicial processes, or (iii) enforce our agreements with you, or protect the rights, property or safety of us or third parties, or as otherwise required or permitted by law.

In the unlikely event of a corporate transaction such as a sale, merger or reorganization or of a bankruptcy or similar restructuring involving all or a portion of BT9, we reserve the right to disclose or transfer your personal information to the non-affiliated third party acquiring company(ies) and other third parties. In the event of such a sale or transfer, we will use reasonable efforts to direct the transferee(s) to use the personal information you have provided through this Website in a manner that is consistent with this Privacy Policy.

We may collect and share aggregate website statistical information (such as downloads, survey results, traffic patterns or related information) with third parties.

Finally, we may hire contractors to provide certain services on our behalf, including information processing and storage, electronic marketing, or other services. These contractors are required to maintain the confidentiality of information they receive from us and are restricted from using the information for any purposes other than those authorized by us.

Such collection and Processing will be made for the following purposes:

  • for the performance of BT9’s obligations under the Agreement;
  • to administer the contractual relationships between BT9 or any of its affiliates and the Customer;
  • to manage and improve BT9’s and its affiliates’ businesses and Products (including to monitor the quality of Products, implement standard sales strategy, consolidate information and provide market intelligence, measure sales force efficiency and increase productivity or for training or risk-management purposes);
  • to promote, market and provide information regarding Products provided by BT9 or any of its affiliates;
  • for legal and compliance purposes;
  • to prevent abuses or fraud;
  • to prepare statistics, tests, customer profiles; and/or
  • for anti-money laundering, anti-terrorism financing and fraud prevention.

The Customer shall procure the Consent of the Data Subjects for BT9 to Process Personal Data for the aforementioned purposes. Refusal of a Data Subject to the collection or Processing of Personal Data may prevent, obstruct or otherwise affect the Customer’s contractual relationships with BT9.

Recipients of Personal Data

Recipients of Personal Data relating to the Data Subjects may include: any affiliate of BT9, including their agents, employees having reason to access and process such Personal Data; institutions, sub-contractors, agents or third parties used by BT9 or any of its affiliates for the purposes of providing any of the Products that may from time to time be provided to the Customer by BT9 or any of its affiliates; regulatory, prosecuting and other governmental authorities, courts and litigation counterparties.

Accessing Your Information

If you are a registered user of the Website, you can update your information at any time. To do this, just log in and update your personal information as needed. You may also contact us to correct or modify the information you provide through the Website. If for any reason you are concerned that the personal information you provided to us is not correct and you cannot change it by accessing your account, or should you wish to have your email address removed from our mailing list or contact information changed, please contact us at support@xsense.co. We will be happy to review, update or remove information as appropriate. We may still retain your information in our files, however, to resolve disputes, enforce this Privacy Policy or our Terms and Conditions of Use, and due to technical and legal requirements and constraints related to the security, integrity, and operation of our Website.

Please check this Privacy Policy periodically to inform yourself of any changes. We reserve the right to modify this Privacy Policy at any time, so you should review it frequently. If we make material changes to this Privacy Policy, we will post such revised policy on our Site and notify you by email or otherwise as permitted by law.
